Dissolution of Marriage in Florida

In Florida, there is no difference between a divorce and a dissolution of marriage. Under Florida law (Florida Statutes Chapter 61), “dissolution of marriage” is simply the legal term used to describe divorce.

In Florida, divorce and dissolution used interchangeably. There are two different types of dissolution of marriage in Florida, one being an uncontested divorce and the other a contested divorce.

Uncontested Dissolution of Marriage

An uncontested divorce in Florida simply means that both parties wish to be unmarried, and that they agree on all of the terms of their divorce.

Contested Dissolution of Marriage

A contested divorce in Florida  means that the parties do not agree upon the terms of their divorce and must negotiate or litigate the terms of their divorce settlement.
